GENERAL TERMS AND CONDITIONS OF SALE – PROFESSIONAL CLIENTS

1. APPLICATION

In accordance with Article L 441-6 of the Commercial Code, these General Terms and Conditions govern the relationship between Hôtel Albert 1er, on the one hand, and professional travelers or individuals or legal entities making group reservations for professional purposes, seminars, meetings, conferences, conventions, events, residential or non-residential, in the course of their professional activity, on the other hand, regardless of the booking method used.
Making a reservation implies full and unconditional acceptance of these General Terms and Conditions by the Client.
The general terms of sale and the specific terms together form an integral part of the sales contract, and their overall acceptance is mandatory before concluding any sale.
No general or specific conditions communicated by the client can be integrated into these general conditions.
In case of contradiction between the booking form (quotation or proforma invoice) and the general conditions, the provisions on the booking form shall be the only applicable ones for the obligation in question.
The Client’s agreement to the General Terms and Conditions of Sale of SARL ALBERT 1ER and the sales conditions of the reserved rate occurs at the time of booking; no reservation is possible without this agreement.

2. CAPACITY

Any hotel guest acknowledges having the legal capacity to engage under these general conditions.
All information accessible on the Website and mobile Services, enabling the reservation of services, is presented in French as well as in several other foreign languages.

3. BOOKING CONFIRMATION

Any reservation is only confirmed upon receipt of the quotation / proforma invoice issued by the hotel, signed and initialed with the mention “Good for Agreement”.
These documents must necessarily be accompanied by the payment of a deposit corresponding to 50% of the total amount of the reservation.

4. PRICES AND PRICE GUARANTEE:

Prices are expressed in Euros excluding taxes and are indicated before and at the time of booking.
The prices indicated only include the services strictly mentioned in the reservation.
An invoice is issued by Hôtel Albert 1er and provided to the Client for each provision of Services.
The conditions for determining the cost of services whose price cannot be known in advance or accurately indicated, as well as the method of calculating the price to verify it, will be communicated to the Client or will be the subject of a detailed quotation, at the Client’s request in accordance with the provisions of Article L 441-6 of the Commercial Code.

The prices indicated are subject to change without notice. The rates confirmed on the hotel quotation are firm for 30 days from the date of the quotation. After this period, they are subject to change depending on economic conditions, with the applicable rates being those in effect on the day of the event.
In the case of a reservation during a trade show or event period, specific conditions may apply and will be indicated at the time of booking.
If applicable, an invoice or credit note will be issued after the group’s stay to adjust the billing.

5. RESERVATION AND RESERVATION GUARANTEE

The Client must submit in writing (email or mail) to Hôtel ALBERT 1ER the list of participants in the event, meals and room assignments no later than 7 days before the scheduled arrival date.
Reducing the number of Participants is considered a partial cancellation of the reservation. Reducing ordered services (number of meals, buffet, cocktail, or others) is also considered a partial cancellation of the reservation.
The Client acknowledges having read the nature, destination, and reservation terms and having requested and obtained necessary and/or additional information to make the reservation with full knowledge.
The Client is solely responsible for their choice of services and their suitability for their needs; the responsibility of Hôtel ALBERT 1ER cannot be sought in this regard.
The reservation will be confirmed by Hôtel ALBERT 1ER via email only after payment is made.
In the absence of payment, Hôtel ALBERT 1ER will not confirm the reservation and will not guarantee the availability of reserved spaces/rooms.
Any request to modify a reservation must be made to the hotel

A reservation modification is firm and final only after receipt of confirmation by the hotelier and acknowledgment receipt to the client.
Modification requests may, if applicable, result in the application of cancellation conditions.

6. PAYMENT TERMS

6.1 PAYMENT

Payment is to be made in the local currency of the country where the hotel is located. Bank charges are the responsibility of the client.
For reservations with or without accommodation, the balance of the total invoice must be paid no later than 7 business days before the arrival date.
The tourist tax must be paid on-site by the participants or the Client before the group’s departure.
The hotel declines all responsibility for any consequences of a delayed departure due to this payment.
Any payment incident suffered by the hotel may result in the termination of the agreement with the Client and/or the cancellation of the reservations without compensation to the client.
In case of late payment beyond the due date specified on the invoice sent to the Client, late payment penalties will automatically be applied at the contractual rate of 10% of the total price (including VAT) of the services listed on the said invoice, without any formalities or prior notice.
In case of non-compliance with the payment terms set forth above, Hôtel ALBERT 1ER also reserves the right to suspend the provision of services reserved by the Client, suspend its obligations, and cancel any discounts granted to the Client.
It is also reminded that a flat fee of €40 will be charged for collection costs in case of late payment.
Any modification or establishment of new legal or regulatory taxes imposed by the competent authorities will automatically be reflected in the prices indicated at the time of invoicing.

6.2 EXTRAS

The payment of extras (laundry, minibar, telephone…) and other services requested individually by one or more participants, notably the services offered in Article 9 of these General Terms and Conditions, which were not included in the reservation made by the Client for the group, will be paid directly by the concerned participants at the hotel reception before their departure (individual payment).
If one or more participants fail to pay for additional services (extras, meals…), the invoice will be sent to the Client, who agrees to settle it no later than 30 days from the invoice date.
In the case of individual payment, the deposit paid at the time of reservation will be refunded to the Client within 8 days following the reception by the establishment of all sums due for the event. Any unpaid amounts will be deducted from the deposit, with the balance refunded to the Client.

7. CANCELLATION

In case of no-show (cancellation without notice) or late booking (7 business days or less between the request date and the booking date), Hôtel ALBERT 1ER will charge the Client a penalty equal to 100% of the total VAT-inclusive amount for the hotel services, seminars, meetings, and events reserved, for the entire duration of the stay.
The reduction in the number of Participants is considered a partial cancellation of the reservation. Reductions in ordered services (number of meals, buffet, cocktail, or others) are also considered a partial cancellation of the reservation.
In case of interruption of the event by the Client, the full agreed price will be charged.
The Client acknowledges having understood the nature, destination, and booking terms and having requested and obtained all necessary and/or additional information to make the reservation with full knowledge.
The Client is solely responsible for their choice of services and their suitability for their needs; Hôtel ALBERT 1ER shall not be held responsible in this regard.

8. SPACE AVAILABILITY

The Client must inform Hôtel ALBERT 1ER before the event date of any changes to the number of participants in the event.
In any case, if the number of participants turns out to be lower than the number stated in the contract/quotation, the Client may be assigned a different space than initially planned, for reasons inherent to the hotel’s management.
It is also expressly stipulated that the Client cannot hold Hôtel ALBERT 1ER accountable if work takes place, during all or part of the services, within or outside the hotel.
The Client cannot claim any financial compensation or damages in case of modification of the initially planned spaces or in case of work being carried out.
Any request for a modification of the setup (change of furniture, room, or any element of the space) compared to the accepted contract/quotation must be made in writing no later than 48 hours before the event begins. Beyond this 48-hour deadline, an additional charge will be applied by the hotel depending on the modifications requested by the Client.
Additionally, in the case of the hotel’s unavailability, force majeure, technical problems within the hotel, or any other reason, it reserves the right to accommodate participants entirely or partially in a hotel of equivalent category, with all transfer costs remaining at the hotel’s charge (except in cases of force majeure), and it will not be liable for any additional indemnity.

9. USE OF SPACES

The Client agrees to use the spaces in a responsible manner. Any behavior contrary to public morals and order will lead the hotelier to ask the Client and/or participants to leave the establishment without compensation or refund of the reserved days.
In case of problems, the Client will be held responsible. In case of damage, the hotel reserves the right to charge the Client the cost of repair or replacement. This also applies to any offense noticed after the Client’s departure, where the compensation amount will be charged to the Client’s card.
Children present are entirely the responsibility of the Client.
For safety reasons and to respect everyone, smoking is strictly prohibited throughout the hotel, including in the rooms.

10. FORCE MAJEURE

Force majeure refers to any event beyond the parties’ control that is both unforeseeable, insurmountable, and external to the parties, which prevents either the Client or the hotelier from fulfilling all or part of the obligations under the contract. Force majeure or unforeseen events are those usually recognized by the case law of the French Courts and Tribunals.
Each party will not be held responsible for the non-performance of its obligations due to a force majeure event. It is expressly agreed that force majeure suspends the performance of mutual obligations, and each party bears the costs resulting from it.

11. HOTEL STAY

In compliance with regulations in some countries, the Client may be asked, upon arrival at the hotel, to complete a police registration form. To do so, the client will be required to present an ID to check if they need to complete the form.
For the safety of people and property, the establishment is under video surveillance with recording.
Animals are not allowed in the hotel.
Proper use of the WIFI is subject to compliance with the WIFI charter, which the Client reviews before connecting.
The Client agrees to use the room responsibly. Any behavior contrary to public morals and order will lead the hotelier to ask the Client to leave the establishment without compensation or refund if payment has already been made. If no payment has been made, the Client must pay for the nights consumed before leaving the establishment.
In case of problems, the Client will be held responsible. In case of damage, the hotel reserves the right to charge the Client the cost of repair or replacement. This applies to any offense noticed after the Client’s departure where the compensation amount will be charged to the Client’s card.
Children are the full responsibility of the Client.
For safety reasons and to respect everyone, smoking is strictly prohibited in the hotel, including in rooms.
Rooms are available to clients from 3:00 PM and must be vacated on the day of departure before 11:00 AM. If exceeded, a “late check-out” fee of €20 will be charged until 4:00 PM. After 4:00 PM, an additional night will be charged.

12. ADDITIONAL SERVICES

a. Services offered by external companies
Hôtel ALBERT 1ER offers to connect clients with external service providers, including:
– Private driver (airport/hotel transfer)
– Dry cleaning service
– Sale of parking tickets, museum tickets, etc.
– Event entertainment companies (team building, group activities, etc.)
Connecting with these providers is possible through the reception or the Sales Manager, where all information regarding these services is available.
Hôtel ALBERT 1ER declines all responsibility regarding services provided by external providers.

b. Bicycle rental services
Hôtel ALBERT 1ER offers bicycles to its clients. The full terms of this service (prices, commitments, returns, guarantee, theft) are available to clients at the reception.

13. COMPLAINTS

Any complaint must be made by registered letter with acknowledgment of receipt to the hotelier within 8 days from the event date.

14. RESPONSIBILITY

The hotel’s responsibility in case of theft or damage to clients’ personal belongings is governed by Articles 1952 and following of the Civil Code.
Identity papers and valuable objects (watch, jewelry, payment means, etc.) must be placed in the mini safe provided for this purpose in the rooms. For larger objects, a safe is available at the reception. Hôtel ALBERT 1ER also offers a paid luggage service at the reception (prices available at the reception or on request by phone or email). Before handing over luggage to the baggage service, the client will list the identity papers and valuable objects contained in the luggage submitted to Hôtel ALBERT 1ER. Since safes are provided in rooms and at reception, as well as baggage storage at reception, Hôtel ALBERT 1ER declines all responsibility in case of theft.
For any commercial event organization, contests, competitions of any kind, exhibitions, or sales, if required by its nature or legal qualification, the Client undertakes to obtain the necessary elements from the competent authorities and act in accordance with applicable regulations and to indemnify Hôtel ALBERT 1ER in this regard. Hôtel ALBERT 1ER may cancel or terminate the contract at any time, solely at the Client’s fault, if it serves as a support for an event contrary to public morality or good morals.
Any project regarding decoration, arrangement, and technical installation of premises must be submitted reasonably in advance to Hôtel ALBERT 1ER for prior written approval. After the event, the Client agrees to remove all installations at their own expense to restore the premises to their original condition. No food or drink brought in by the Client or their guests will be allowed without prior authorization from the hotel.
After midnight, the noise level in the lounges must not disturb Hôtel ALBERT 1ER’s guests or its immediate surroundings. Hôtel ALBERT 1ER reserves the right to limit the noise level in case of excess. The Client agrees to comply with the specified hours for space and lounge occupation in the special conditions.

15. RELOCATION

In case of an exceptional event or inability to provide the reserved room to the Client, or in case of force majeure, the hotel reserves the right to accommodate the Client entirely or partially in a hotel of equivalent category, for services of the same nature, subject to the Client’s prior agreement.
Any additional costs for the room, transport between the two hotels, and a phone call will remain at the hotel’s charge.

16. CONTRACTUAL GUARANTEE

The Client benefits from a contractual guarantee for any non-conformity of the service.
It is noted that the photographs presented on the website or by the partners are for illustrative purposes only. While best efforts are made to ensure the photographs, graphic representations, and texts used to illustrate Hôtel ALBERT 1ER provide the most accurate preview of the offered accommodation services, variations may occur, notably due to changes in furniture or potential renovations.
Hôtel ALBERT 1ER cannot be held responsible for non-performance or poor performance of the reservation in case of force majeure, third-party fault, unforeseeable and insurmountable events, Client fault, including unavailability of the internet network, inability to access the website, external intrusion, computer viruses, or unauthorized prepayment by the bank.

17. USE OF PHOTOGRAPHS

During their stay at the hotel, the Client may be asked for consent to be photographed and for the use of these photographs. Once consent is granted, Hôtel ALBERT 1ER may use the photographs for any public projection, advertisement, press, social media, website, or electronic publication.
Hôtel ALBERT 1ER expressly prohibits any use of photographs that may harm the privacy or reputation of the photographed person(s), or use of the photographs for any harmful exploitation. Hôtel ALBERT 1ER will provide a proof of publication to the photographed person upon simple request.
By granting consent, the photographed person(s) confirm(s) that the consent is given knowingly and without compensation. They will not claim any remuneration for the use of the images.

18. DATA CONFIDENTIALITY

Hôtel ALBERT 1ER collects, processes, and uses the Client’s personal data only if the Client has given prior consent or if legal provisions allow it. Hôtel ALBERT 1ER collects, processes, and uses only the data necessary for the operation of its services and online portal and/or services offered there.
Hôtel ALBERT 1ER will never sell this data to third parties. Data is only transferred to third parties if necessary for booking purposes with the chosen accommodation provider or for providing other services by Hôtel ALBERT 1ER. This explicitly includes any transfer of data to subsidiaries or other contractors involved in processing the booking, in compliance with applicable contractual structures and legal confidentiality regulations.

19. DISPUTE RESOLUTION

The Client is informed about the possibility of using conventional mediation procedures or other alternative dispute resolution methods in case of a dispute regarding these general terms, as provided in Title I of Book VI of the Consumer Code.
After contacting customer service or the hotel to resolve the dispute amicably, and if no response is received within sixty (60) days, the Client may contact the Tourism and Travel Mediator. Information (contact details and how to reach the mediator) is available at https://www.mtv.travel/contact/.
The mediation request must be made within twelve (12) months from the first complaint.

20. APPLICABLE LAW

Any dispute, claim, or litigation related to the booking terms of a stay or hotel room is subject to French law, without prejudice to any mandatory protective provisions that may apply in the consumer’s country of residence.
